Odafree is considered a "food" by the FDA, not a drug. This means like many thousands of other vitamin, supplement, and nutritional products, Odafree does not get involved with the FDA. Congress defined the term "dietary supplement" in the Dietary Supplement Health and Education Act (DSHEA) of 1994.

A dietary supplement is a product taken by mouth that contains a "dietary ingredient" intended to supplement the diet and is placed in a special category under the general umbrella of "foods," not drugs, and requires that every supplement be labeled a dietary supplement. Dietary supplements do not need approval from the FDA before they are marketed, and there are no FDA regulations specific to dietary supplements that establish a minimum standard of practice for manufacturing dietary supplements.

Information that must be on a dietary supplement label includes: a descriptive name of the product stating that it is a "supplement;" the name and place of business of the manufacturer, packer, or distributor; a complete list of ingredients; and the net contents of the product. Odafree is considered to be a "dietary supplement" under DSHEA and therefore does not require FDA or other approval. This was confirmed in great detail with the FDA's New England regional director before Odafree first went to market in 2005.

While not required to do so, Odafree is nevertheless manufactured under certified "Good Manufacturing Practices" set forth in the Quality System (section 520) of the FDA's Food, Drug and Cosmetic Act. To maintain certification, Odafree's manufacturer keeps strict adherence to labeling requirements which you see on the bottle, including the disclaimer that FDA has not evaluated the product or any claims related to Odafree. The disclaimer also states that Odafree is not intended to "diagnose, treat, cure or prevent any disease," because only a drug can legally make such a claim.
